Review of The Electronic Contract In Civil and Commercial Codes

The article “The Electronic Contract In Civil and Commercial Codes” by Ahmad Mahmoud Al Masadeh , Ahmed M.Khawaldeh , Mohammad Assaf Al-salamat describes how legal frameworks cannot adapt fast enough to the rapid pace of the digital age. It is based on a study regarding how electronic contracts are created, their obligations, and their effects on online commerce particularly through email. It begs the question of how electronic contracts are defined within the law and if they are equivalent to traditional paper contracts. The article provides valuable insight on how electronic commerce is a benefit to society and the economy. 

Through this study the article concludes that electronic contracts are usually made through online platforms such as social media or online marketplaces using email as a channel for electronic transactions. This promotes economic prosperity in many markets. It allows for easily accessible economic transactions for many communities, however the difference in digital literacy levels can become an issue. Not everyone may understand the ramifications of agreeing to an electronic contract and allowing an online website access to your information. This is why we need laws in place to protect people’s rights while in cyberspace. 

This article suggests that the laws of the physical world cannot keep up with the laws of cyberspace. From a social science standpoint, electronic commerce promotes connection through people and allows us to study human behavior from data collected from all over the world. It also demands that our legal systems adapt quickly to the ever changing cyberspace and put guidelines in place to protect the privacy rights of individuals. 

This article concludes that given the right construction of an electronic contract they can be as effective as a traditional paper contract. Electronic contracts have become invaluable to modern commerce promoting social and economic transactions. Though with the rapid advancements in technology we need legal systems that can adapt just as quickly in response.
