Several social and economic theories can be applied to the sample data breach notification letter; however, these four theories are the most fitting, the first of which is the economic theory of rational choice theory. The letter’s intent of informing customers of the breach rather than coving it up helps to build a reputation of trust and responsibility with consumers. The second theory that relates to the letter is market failure. This theory reflects on where the platform provider’s systems were compromised, leading to a failure in providing the secure environment customers expected. Data breaches affect not only the organizations involved but also the consumers who rely on them to protect sensitive information. The two social theories that apply best to the letter are social contract theory and routine activities theory. The letter raises questions about the responsibilities and expectations between the service provider and its customers. In the data breach context, customers expect the platform provider to uphold its end of the “digital social contract” by ensuring the security and privacy of their personal information. Routine activities theory implies that crime occurs when three elements converge, a suitable target, a motivated offender, and the absence of a capable guardian. In the data breach context, the absence of a capable guardian could be interpreted as insufficient cybersecurity measures to prevent unauthorized access.
