Article Review 2


The Article “Digital Justice in Jordan: The Role of Virtual Arbitration Sessions in Modernizing the Legal System” by Sadam Mohammad Awaisheh tackles the topic of the legal system in Jordan, how currently there are already rules in place that limit the use of virtual arbitration, and how it may be worth looking into changing that. Arbitration is a common way of settling disputes in Jordan, so common that laws codifying what can and cannot be done in arbitrations were passed in 2018. This became a problem when COVID-19 struck though, as there were already limitations placed on doing these arbitrations virtually due to concerns of cybersecurity. This study aims to find out whether or not allowing virtual arbitration would be worth those risks.

This study was done without concrete measurements, but rather using real world examples and case studies to attempt to draw a conclusion. Awaisheh mentions topics like the cost effectiveness of virtual arbitrations, both in resource and manpower, how convenient people find virtual arbitrations compared to traditional ones, as well as the cybersecurity risks that do come alongside virtual arbitrations. The author uses these points to draw the conclusion that the convenience and cost effectiveness would make switching to virtual arbitrations worth it, as the costs you save by not having in person arbitrations can go towards tightening up cybersecurity.
Conclusion
I have never done a journal review for a journal without much in the way of studies performed before, but I will say that Awaisheh’s writing and use of sources was convincing. After reading this article I do believe it would make sense for Jordan to adopt virtual arbitrations and perhaps even do away with in person arbitrations.
