How should we go about fixing it

It is true we have come far in technological advancements. And because of that it has opened up some negative effects. A couple of those being cyber harassment or stalking. The legal system employed here isn’t as good as we would think it is. We understand what harassment and stalking is as a concept but there is no clear definition of what constitutes “cyber harassment” or “cyber stalking” in the United States (Baer, 2010; Fukuchi, 2011; Goodno, 2007). The general forms of stalking and harassment are different from the cyber forms. This is what causes a disconnect in the legal aspect. There are 5 main points that make cyber stalking different from regular those being: a message can be sent to anyone anywhere long as there is internet access, stalker can be anywhere in the world, stalker has the ability to stay unknown, could use another identity to stalk someone, and stalkers may use third parties. Because of these reasons they can not use legislation they already have for regular stalking and harassing because that requires a physical presence. Legislation wise for local, state, and federal they need to just go ahead and change the rules. We understand one part of the presence aspect. We need to make a separate branch of charges that can be expressed through the use of the internet. It’s not really a hard concept to do since they did it for cyber bullying. I think they should keep the system they have in place for categories to go off of though. The six areas they look in for a charge are intent, anonymity, alarm/distress, prior contact, jurisdiction, and age reference. There are other facts in the categories they have but not every state addresses them. That is a good addition to crack down on cyber stalking and cyber harassing. The more criterias they have, the better it will be to convict and charge these cyber criminals. Moving forward with any technological advancement I think there should be rules that limit them.
