What is the overlap between criminal justice and cybercrime? How does this overlap relate to the other disciplines discussed in this class?

A: Before answering this question, there’s an important distinction to be made between criminal justice and what is known as criminology. Criminology focuses more on the “scientific study of crime” and why crime is committed (Vito et al., 2015). Meanwhile, criminal justice focuses more on the procedures and preventions of criminal activity. These definitions are relevant to the question because criminology answers a lot of reasons as to why people commit cybercrimes, the criminal justice system is focused on preventing both real world crimes and cybercrime. Simply put, crime defined by the criminal justice system is ““illegal acts committed in violation of the criminal law” (Payne et al, n.d.). Moreover, despite fraud, impersonation, break-ins, and other variations of these crimes may first appear as only something that occurs in the real world, these crimes are incredibly prevalent in the world of cybersecurity. In fact, according to a study from the American Journal of Criminal Justice (2018), the most committed cybercrimes are “Hacking”, “Fraud Scheme[s]”, and “Tracking Counterfeit Goods” (Payne et. al). Furthermore, all of the data and cases of cybercrime were collected from real cases from “the U.S. Department of Justice between 2013 and June 2017”, which shows the seriousness of these crimes in the context of the law (Payne et. al, 2018). Essentially, cybercrimes are just as serious and severe as real-world, non-cybercrimes, and the criminal justice system takes these crimes just as seriously as any other crime. One discipline that fits into this overlap of criminal justice and cybercrime comes with criminology, as several criminological theories help the criminal justice system determine what leads a criminal to commit a cybercrime and how to prevent this. For instance, one theory called “routine activities theory” outlines three components that compels someone to commit a cybercrime: “ the absence of a capable guardian, the presence of motivated offenders, and a suitable target” (Payne et. al, 2018). Using this, the criminal justice system can use this theory to determine possible victims and entice hackers or cybercriminals to attack in order to catch them.

References:

Payne, B.
